HAJI MAHMUD BIN DATO’ HAJI SALLEH

Barrister-at-law, Middle Temple. Called to the English Bar in 1971.

EXPERIENCE

 

Haji Mahmud has been in practice since 1973. Haji Mahmud was employed as a legal assistant with Messrs. Lim Lim & Oon and was thereafter appointed as a partner of Messrs. Presgrave & Mathews in 1978 until 1981.

 

Haji Mahmud specializes in probate and administration, estate planning and trusts, conveyancing and banking which includes matters relating to building management, joint property development, leases and tenancies, project and retail property transactions, property joint venture, property related acquisitions and divestments, property link financial transactions, public auction and tenders and property related project finance.

 

In addition, Haji Mahmud also has experience in civil litigation. His practice in this area of the law involves trade financing dispute, landlord and tenant disputes, banking and securities litigation, debt recovery and matters relating to insolvency of individuals and companies.

 

SAYANG BINTI IDRIS

EXPERIENCE

 

Sayang practised in Messrs. Presgrave & Mathews as a legal assistant and was made partner in 1978. She continued to be a partner of Messrs. Presgrave & Mathews until the inception of the firm.

Sayang specializes mainly in conveyancing and banking matters and has advised most of the banks in Malaysia. Her work includes documentation ranging from corporate loans, commercial loans to retail and consumer loans. Sayang has also been involved in matters pertaining to documentation in respect of fixed and floating charges/pledges.

In addition, Sayang is also experienced in matters relating to development projects, land related joint venture, exchange of land/property transactions, leases and tenancies, project financing as well as corporate financing transactions and has been involved in negotiations and finalizations of documents for the development and financing of commercial, industrial and residential properties.

EXPERIENCE

 

Shahrul was previously a partner in a prominent Kuala Lumpur-based firm before joining the firm in 2012.

His major area of practice relates to conveyancing and banking law and he is well-versed in conveyancing and banking practices in Malaysia, be it conventional banking or Islamic banking. His banking experience covers a broad spectrum of work comprising from advisory work to review of documentation for some of the leading banks and financial institutions in Malaysia. In addition, his work also includes preparation of documentation ranging from corporate and commercial loans to retail and consumer loans. Shahrul also has extensive experience in providing advisory services to borrowers and lenders on issues pertaining to real estate financing.

Other areas covered under Shahrul’s conveyancing portfolio includes advising clients on property linked financial transactions, acquisitions and divestments of properties, estate planning and trust, leases and tenancies as well as licensing and regulatory approvals from government agencies such as the Economic Planning Unit of the Prime Minister’s Department and other Malaysian governmental and regulatory bodies. In addition, during his tenure in Kuala Lumpur, Shahrul has been involved in advising key developers in various residential, commercial and mixed development projects, including making various licensing and regulatory applications to various governmental and regulatory bodies.

Apart from Shahrul’s conveyancing and banking work, Shahrul also practises in the major areas of corporate/commercial law, acting for businesses across various industry sectors. Acquisitions and disposals constitute key areas of his practice as do commercial agreements of all sorts.

EXPERIENCE

 

Prior to joining Messrs. Haji Mahmud & Partners in 2012, Lauren was a Legal Assistant at the firm of Messrs. Shahrizat & Tan and at Messrs. Raja, Darryl & Loh, and thereafter a Partner at Messrs. Siong & Rita. Her core area of practice is civil litigation, including in the areas of general litigation, banking, finance and insolvency litigation. In particular, her civil litigation experience covers: 

  • debt recovery for goods sold and delivered and services rendered;
  • contract claims;
  • recovery actions (civil action and foreclosure) including bridging loans, trade facilities, overdrafts, term loans, debentures, fixed loans, share margin financing, housing loans, hire purchase and leasing;
  • tortious claims including negligence, trespass, nuisance;
  • execution proceedings including contested bankruptcy and winding-up proceedings; and
    shareholders’ dispute resolution and minority oppression proceedings.

Lauren has since expanded her practice area to include corporate litigation, family and matrimonial-related disputes, probate and administration and some Industrial Court and employment matters.
